Do you see what's happening in Michigan? You don't care because it's not northwest Arkansas. Okay, well, try really hard to understand what I'm about to tell you, one sentence at a time, and be watching the news in the coming months.
Due to our hatred of sex offenders, we allowed the government to enact sex offender registry laws. All sex offenders are required to register upon leaving prison whether their offenses were committed before the registry laws went into effect or not. This violates what we call the "ex post facto clause" of the United States Constitution. Some states, however, have successfully ruled that the laws violated the ex post facto clause and have changed their laws to register only those who offended after the laws went into effect.
So, all that said, last year in Michigan in a case called Doe vs. Snyder, the 6th circuit (a federal appeals court) told Michigan that some of their sex offender registration laws are punitive in nature and unconstitutional if retroactively applied. Well, the State of Michigan decided to appeal to
0). Many things can happen as a result.
SCOTUS can refuse to hear the case. This would mean that Michigan is forced to change their registration laws, and so would all the states in the 6th circuit: Kentucky, Ohio, and Tennessee. That could also have a ripple effect to the other circuits, to include Arkansas as well.
SCOTUS could hear the case and finally declare retroactive application of sex offender laws to be unconstitutional due to their conflict with the ex post fact clause.
Or, they hear the case and simply uphold the Michigan statute, as is, claiming the 6th circuit court wrong in their ruling. If this happens, then sex offender laws throughout the US will become even more strict. Also, this opens the door for the registration of ALL felons, not just sex offenders.
I want to know if a convicted drug dealer lives in my neighborhood and I don't believe he or she should be allowed to reside within 2000 feet of a school, park, lake, daycare, or church.
Not just drug dealers, but anyone convicted of any drug offense.
They might try to sell drugs to my children or try to get them high or addicted to meth.
The same is true for thieves. They should be on a registry too. I don't want my kids to be around people like that so they should not be allowed to live within 2000 feet of a school, park, lake, daycare, or church. They might try to con my children into helping them rob a store or something.
Eventually, they will even classify anyone who has ever used the internet to meet someone (for a date, selling or buying something, or even for work) as "planning" to do something illegal and all of us will have to be on the registry since the laws will apply retroactively.
Hey, I know quite well that some of what I have said here pisses off a lot of people, and rightly so. But, I'm right, huh?
Think, people. Think. You opened the door to allow the government to register its citizens. Then you worry about all the books that have been written about "big brother", the Bible mentioning possible numbers on everyone, microchips implanted in every person.
Are we doing this to ourselves? Learn to keep the government restricted instead of giving it such far-reaching powers into our lives.
